Anyone have any ideas - car repod and everything taken out!!!

flirtycuddle wrote: Ok so my ex made a stupid choice and forgot to pay his car payment. We got it all figured out and paid everything they asked for with in hours after finding out it was repoed. Went to pick up the car today and every thing that was in there is gone. I am talking both car seats that I just bought for $300 3 months ago and even my purse that has all my ids and work stuff in. The finacnce company turned it over to the dealership and when we went to get it all the stuff was missing. INCLUDING insurance cards and the contract for the car payments. They are trying to say they dont have to give any thing back but how can that be. We just paid 6 months payments and the fees. I dont know if anyone knows what I can do. I cant even cash my check to pay the other bills that are due till I can get my wallet and such back.

And the car has major damage so now we have to figure out what to do since we paid so much out already and the car isnt even worth it.

luvmykids replied: That sucks! hug.gif I don't know how a dealership could get away with that, maybe tell them you're going to file a police report on the items? Good luck, I would be LIVID growl.gif

flirtycuddle replied: They put it all in storage and its 100 a day to get it out even though we paid it yesterday but wouldnt release the car till today. Then to add to it the drive train is busted some how cuz of the tow truck. The financer since they towed it said to go get it looked at and then they'll see if it's gonna be fixed by them or we are sol. Luckly we have the bumper to bumper warrenty on it so if they say we have to do the saturn dealership will cover it.

gr33n3y3z replied:
They sure can and he missed more then one car payment they wont do it for one maybe 3 or 4 but not one its not cost effective for the dealership.

Mommy2Isabella replied: Unfortunately it is completely legal for them to take all of "your" things out of the car. Its one of those things, since he hadn't paid anything in the car becomes theirs when they tow it.

Sorry hun! Maybe you will get lucky and get your stuff back!

luvmykids replied:
I meant not giving them their personal belongings, like car seats and her purse. What does the dealership do with them anyway, that they won't give them back? I guess I can see where they'd say anything in the vehicle is theirs now but if they've paid the money to get the car back, why don't they get their personal items back too?

flirtycuddle replied: Actually no it was one payment 2 weeks late. I paid the last one myself while he was at work and he's only had it 2 months so no way it could be 3 or 4 payments. I understand the car was theres when they repod it but we paid 6 months of payments now and the fess so how in world is it theirs?? We did beyond what was asked and paid the next 5 months now plus the 300 repo fee. We contacted a lawyer last night and sure enough since we paid with in 2 hours of it being repod what they did was illegal. They have to give us back the items or we can go after them and they have to fix the drive train that their tow company messed up or they can be held liable.

Kaitlin'smom replied: is this one from a buy here pay here place?

~Roo'sMama~ replied:
You mean they actually repossed your car after you missed ONE payment? ohmy.gif That's crazy! Don't they have to at least send you a couple letters of warning or something? Good grief... I'd be so pissed!! dry.gif I can't believe they took your purse and carseats too... I hope you get them back. hug.gif

lisar replied: BY LAW they have to let you have your stuff back. They cannot keep it. They can charge to hold it though. 100 dollars seems a little high though. We dont charge at all as long as they come in a timley manner. (most of them the next day) As far as breaking the car I have never encountered it done like that so I dont know about that. Good luck with it all. Let me know it works out.

amynicole21 replied: I'd have the lawyer make a threatening phonecall or write a letter if I were you. Though it might cost you some $ to do that, too. rolleyes.gif Sorry. That situation sounds TOTALLY illegal in my opinion.

gr33n3y3z replied:
sounds like a shady dealer I say let them have the car and I no way would have made that many payments in advance if you were only truley only one behind

I say call a lawyer

flirtycuddle replied: It was one payment with no warning letters either so we have already involved a lawyer. And the storage fee is $100 a day. We paid everything within hours and they didnt allow us to come get it till last night. It was already back at the lot all cleaned up and such. The fing tow truck driver hooked up the car by the transmission and cracked it!!! It has 2 tow hooks on it so now its another 2200 to put in a new tranny since the tow company says they did no such thing. The place fixing it said it should have never been driven off the lot and we dont even know how it worked and said since its a danger to drive it couldnt be driven off the premisie which i understand and even wrote up a letter for the lawyer saying it was towing by tranny that did the damage. The finance company is country wide fincial and are saying the tow company has to pay to fix not them. This is just a huge mess. He was paying it the mornign it was towed when I went out to get my purse and walk the dog and my daughter says "where's daddies car" We are hoping to tell them to take the car and f off after this whole fiasco with our money back to us but we diont know yet what is going to happen but the lawyer made this a top priorty since there is no excuse for this stuff.
