Here is what he is doing:
1. Filling a motion for contempt of court for non-payment 2. Filing a motion to dismiss--the paper work they sent me is wrong 3. Filing a motion for more definite statement--(theres no way he has 9 grand in bills) 4. Filing a motion to disqualify his lawyer -apparently the same person that represented me in the original child support case can NOT now represent him against me. 5. Filing a motion for an increase in child support.
In the paper work it states that the petitions allegations and supporting basis are frivolous pleadings.
Oh and he is going after ALL attornery fees. But I had to pay him first. $1500.00 all of that for $1500.00 isnt bad.

And I am not sure how that all goes. I know if I dont have a job I still have to support her so they look at it the same way. They dont look at it as if he doesnt have to pay still. With or without a job he is still supposed to pay.

5) This will only happen if he has higher income...if your income has also become higher, generally that keeps the support from raising too...unless you are in one of those "father income only" states
Also, I wouldnt count on lawyer fees & court costs. Generally its been my experience that the judge has each party pay their own.
And if he isnt paying support, I wouldnt count on him paying MORE support, let alone lawyer fees & court costs, so you should be prepared to pay the lawyer more when the retainer runs out (and it almost always does....the last time my husband had to go to court with his kid's mom, we went almost $2k over the $3k retainer...)
lisar replied: I am in a father only state. And I didnt pay a retainer fee. The $1500.00 is for the whole thing. And I know I might not get an increase but why not go after it. And no he doesnt own his own business he lied on the paper work. You should see his paperwork. Even the lawyer looked at it and said there is no way. And according to the paper work he has NO income. Which is the funny part cause right now he does have a job. And honeslty I dont expect to get the lawyer fees back I know that hardly ever happens. Suck I wish it would but I know it dont.

& if you are getting off for $1500 for the whole thing, thats great. Does that include if he decides to go for visitation?
My2Beauties replied: I actually think $1500 is steep for a retainer..Desiree's mom Staci only had to pay $1200 for hers and that was no discount Her lawyer is $135 an hour, so once her retainer runs out that is what she has to pay. Maybe it's cost of living, I don't know where you live. Anyways, down here a lot of times too with cases I know of, the part who filed the motion, if they are found that they are filing frivilous claims (such as what this sounds like) the judge does make them pay the other person's court costs...I guess it's different everywhere you go.
