Legal question..maybe someone has some insight..
Boys r us wrote: 2 weeks ago we went to a restaurant and I left my cellphone on the table b/c it got kinda chaotic with Alliebelle throwing a temper tantrum and us getting out of there as soon as we were done. Well, I immedietely called back there to see if they had found it and I got an instant NO..no one even offered to look or ask..just a no. Kinda irritated me..but at that point I thought..well maybe it's in my car or diaper bag..so we didn't cancel it for a couple of days until I looked everywhere and just gave up. Before we cancelled it, Rick called it and several times a girl answered and hung up on him right away. So...I got my new cell a week later and checked my voicemail, there was a message for someone named Diane Montgomery from an insurance place. We also pulled a detailed phone record and have tons of phone numbers detailed that she called and text messaged, incurring a lot of fees beyond our normal plan. So....last night we went to the same restaurant and on a whim I asked a girl who worked there if there was someone there named, Diane montgomery..she said yes, but that she wasn't there. I asked for the manager before I left. I wanted to tell him what happened and that she had taken my phone and had been using it. I was going to offer for him to ask her to return it and I could pick it up there no further questions asked..I mean..it's a $400 cell phone, I'd like to get it back! So..he tells me she no longer works there as of last week and he suggested I just get a warrant for her for stealing it. I would like to do this, it's no longer about the phone, but just principle. Once I realized I lost it, I didn't expect to really get it back..my loss..but it really angers me that someone took it and not only used it but bought a charger for it and everything b/c it was near dead when I lost it..so she planned to use it for as long as possible and was giving people out the number and everything. So..if I go to the police station with only her name and her last known employer, can they do anything? I mean I don't have an address for them to find her. Would they be able to get her address from the restaurant? Is this just a lost cause? I know she's probably dumped the phone now that it's been blocked stolen, but I just want to see her in trouble for being such a witch!! I mean, it's not like she found it on the street..she found it at her place of employment that one of her customers left behind!

I mean, her myspace page etc probably has loads of leads about where she lives and if something evil (like toilet papering of her home etc) then...well...karma ya know?
Boys r us replied: It's such a generic name Cary! LOL and I mean, not to cast stereotypes that make me sound like a total snob..but she works(worked) in a restaurant and has to steal a cellphone to have a phone..so she likely doesn't even have a home of her own to toilet paper! LOL
Boys r us replied: I'm looking her up on the local court system website to see if she has any previous violations. Okay..4 pages of viloations on just 1 city court website! Yeah..I'm going to the police..sure I'll never be reimbursed for the phone or the extra charges, but maybe she'll go to jail! She stole the wrong chick's phone!

I lost my phone once, I called it and this kid answered....when I said I'd like to get it back he said "NO way lady, this is a good phone and you're the one who lost it"

I would definitely call the police.

Boys r us replied: That's great Teesa! I'm happy you have a paid for condo..but that wasn't really the point...I didn't single out anyone who just doesn't have a phone. If you stole other people's phones to have one to use from your place of employment and had a 4 page long criminal record, then my above statement would have applied to you. You can't just take half of someone's sentence and not the other and try to be offended by it. That's like if you said "school teachers who abuse children are evil" and someone said, "Hey I'm a school teacher, you offended me!" Well, unless that person is a school teacher that abuses children..no need to be offended..right?!?

Boys r us replied: I filed a police report this morning and stated that I DID want to file charges. I gave them all of the info and the magistrate's office said an investigator will be contacting me about it. She said that the value of the phone alone being more than $200 is enough to prosecute her for Grand Larceny, which in VA is a felony. I told her I didn't care about getting restitution, but I just wanted her to be punished and she said..well, there is no way she can deny this with a detailed record of all of her phone calls and voicemail messages being left for her.
Anywyas..yay!! I'm excited!
