Update: My Dad and his accident last month

The trooper said he is going try get him off with little as possible. Meaning he will probably loose his license for 6 months and a fine. My brother said he will try help my dad pay the fine. Because he don't want see him in jail.

So please, please pray that dad will not end up in jail and they will only suspend his license. I just don't think he would make it in jail, he is still pretty sore from the accident.

We find out Wednesday what they are going to do. sad.gif unsure.gif

I don't know what your rules are in the state he's in, but I know here in Ak, you have to spend 3 days in Jail... and pay a bunch of fines, and take a class, and after 90 days, you can get your DL back....

I only know this cause my DH got a DUI a few years ago.... when we first started dating....

I hope it all works out..... and he don't have to go to jail....

3xsthefun replied: Yeah, guess you all are right. But still I hate see him end up in jail since he is my dad and all. Far as I know that 3 days in jail is not mandatory here it might be. I'm really hoping he just gets his license suspened for 6 months and a court fee is all.

Oh, well guess we will find out for sure tomorrow. I am guessing it won't be very much time even if he does get jail. Our magistrate court is kinda screwed up around here. I should know since my brother already there for hitting mailboxes. They told him he would have pay bunch money, turned out he only payed $200 court fee and payed for the people's mailboxes he hit. Of course I know a DUI is more serious then what my brother did.

If he does get his license suspended he should be ok. He has ways to still get to work.

jcc64 replied: I believe it's the district attorney's decision whether or not your dad will be prosecuted- not the trooper's. The arresting officer may say things to make it better or worse for your dad, but technically he has no control over the sentencing.
Here in NY, first offenders don't receive jail time unless there is some other extraordinary circumstance (someone gets hurt/killed, etc). Usually, it's just ALOT of fines, insurance surcharges, community service, and loss of license for 6 months. I suspect your dad won't do jail time if it's a 1st offense.
I hope things get better for you and your family.

3xsthefun replied: I'm not really sure how they do it WV. I'm pretty sure they won't make him go jail this being is his first time. As for who will be charging him with what I believe that is up to our magistrate court. I don't think district attorney has anything do with it but then again I could be wrong. unsure.gif

I couldn't even imagine my father in jail, even though he does drink a lot and I'm scared every day that he's going to hurt someone or himself, I just wouldn't want that on him. I'm not exactly sure what happened with your dad, whether the accident was his fault or not, but I wish it works out. smile.gif

3xsthefun replied: Yes, the wreck was pretty much his fault. He was drinking when the wreck happened and luckly he was only one involved in the wreck. He did get hurt really badly, he was thrown from his truck. They had to fly him out to another hospital that had a trauma center. He ended up with a broken hip and pelvic bone, and alot of cuts and scars on his face. He was lucky not to had anymore injuries to his head or anywhere else.

I sure hope everything works out ok for him today.

I didn't realize that was what happened. He's definitely in my thoughts and I hope this is a wake up call for him. Since he was alone in the accident I would assume he'd just get a DUI and not a jail sentence, hopefully.

As someone who has lost a few loved ones due to drunk drivers and had to witness a horrific open casket of one of them I really seriously hope your father does know how lucky he is to be alive and that no one else was hurt. I'm not preaching here so please don't think this. I always want to support people but I also have that other side of me that has lost to those who drink and drive.

I do believe has learned him lesson big time, he even said it was one of his rules for himself, to never drink and drive. We all knew he was getting really bad I don't know if he was depressed or alot.

I'm not trying to make excuses for him but he had a lonely job. He was on the road alot away from family. My mom works lot of weekends, plus my brother was out and about. He was home alot of times alone so he would drink alot.

I guess we will never really truly know why he drank so much. Because I know he does not like talk about it.
